1. INTRODUCTION

These Terms and Conditions ("Terms") govern the use of the Arewa Smart platform operated by Arewa Smart Idea Ltd ("Arewa Smart", "we", "our", or "us").

By accessing or using our services, you agree to be legally bound by these Terms under the laws of the Federal Republic of Nigeria.

You confirm that: You are at least 18 years old and have the legal capacity to enter into binding agreements.

2. NATURE OF SERVICE

Arewa Smart is a digital service platform and intermediary, providing access to utility and financial-related services through third-party providers.

3. SERVICES PROVIDED

Core Services:

• Airtime purchase & Data subscriptions
• Utility bill payments & Educational PINs (WAEC, NECO, etc.)
• Gift card transactions & Other digital services

Additional Services:

• NIN Services (Validation, Modification, IPE)
• BVN Services (Search, CRM updates, Enrolment, Reports)
• Agency Banking & Wallet Transfers

All services are processed instantly but are subject to third-party availability.

4. USER ACCOUNT RESPONSIBILITIES

Provide accurate info, maintain credential security, and be responsible for all account activities. We are not liable for user negligence.

5. WALLET, PAYMENTS & CHARGES

• Wallets funded through third-parties (e.g. PalmPay).
• Transactions are pre-funded and debited instantly.
• Charges apply for API verification, transactions, and slip generation.

Charges apply once a request is successfully processed. Successful verification or retrieval constitutes a billable event.

6. TRANSACTION POLICY (FINALITY RULE)

All transactions are: Instant, Final, and Irreversible once processed.

7. REFUND POLICY

Eligible Refunds:

Transactions that fail due to system error directly caused by Arewa Smart.

Non-Refundable:

Incorrect user input, third-party failures (API, bank, network), successfully processed transactions, and NIN Validations.

8, 9 & 10. DISCLAIMERS & LIABILITIES

We act solely as an intermediary. No warranty for continuous 100% availability. Liability is limited strictly to the amount of the transaction in dispute. No liability for indirect or consequential damages.

11, 12 & 13. COMPLIANCE & GOVERNANCE

You indemnify us against misuse. We comply with AML regulations, perform KYC, and reserve the right to suspend accounts or freeze funds for fraud or regulatory risk.

14, 15 & 16. USAGE & DATA PRIVACY

Prohibited use includes fraud, money laundering, and identity theft. We collect Name, phone, email, BVN, NIN, and transaction data for service delivery.

We share data with third parties where necessary (e.g., PalmPay) or required by law.

18, 19 & 20. FORCE MAJEURE & RECORDS

No liability for network failures, cyberattacks, or natural disasters. Account termination for breach. System logs serve as prima facie evidence in disputes.

DISPUTE & CONTACT

Disputes settled amicably first, then through arbitration in Nigeria. Governed by Nigerian law.
